1. About CelebKart

The Platform is owned, managed, and operated by Thunderbolt Creator Technologies, a corporation registered in Bengaluru, Karnataka (“Company”, “we”, “us”, “our”).

CelebKart Features: CelebKart is a web-based service that provides an online platform for creators to create, design, publish, and sell digital services such as consulting services, content subscriptions, live streaming events, and 1:1 interactions (“CelebKart Features”).
Content: Any content created, uploaded, or made available by a Creator on the Platform, including but not limited to the CelebKart Features, is referred to as “Content.”
Creation of Content: Any User can create Content in live or pre-recorded formats and manage it in an organized manner using the Platform’s features, including integration with third-party payment processors.
Subscriptions: The Platform allows Creators to set up monthly subscriptions to enable Subscribers to access Content, interact with each other, and with the Creator (“Subscriptions”).
CelebKart Services / Services: Facilitation of Content creation, distribution, Subscriptions, and all associated Platform features and services are collectively referred to as “CelebKart Services” or “Services.”

It is essential to recognize and accept that the CelebKart Platform functions solely as a platform service provider. CelebKart does not create Content on behalf of Creators, nor does it operate as an educational institution.

These Terms of Service (“Terms”, “Agreement”) govern Your use of CelebKart’s website and mobile application, currently accessible at www.CelebKart.com and any associated domains or subdomains.

By accessing or using the CelebKart website or mobile application, You agree to be bound by these Terms of Service. If You do not agree to these Terms, You must not use the Platform.

2. Conditions of Use

These Terms of Service constitute a legally binding Agreement between You and Thunderbolt Creator Technologies in relation to Your use of the Platform.

This Agreement governs the use of the domains (including but not limited to CelebKart.com) and all associated features, subdomains, content, functionality, services, media, applications, discussion forums, or solutions offered through them (collectively, the “Platform”).

These Terms apply to:

Creators – individuals or entities who create, publish, and/or sell Content or Services on the Platform.
Subscribers – individuals or entities who access or purchase Content or Services from Creators through the Platform.

Collectively, Creators and Subscribers are referred to as “Users,” “You,” or “Your.” Where applicable, “You” also includes any legal entity You represent.

These Terms must be read together with:

(collectively, the “Agreement”).

By accessing or using the Platform, You acknowledge that:

You have read, understood, and agreed to be bound by this Agreement.
You have the authority to enter into this Agreement, and doing so does not violate any other agreement to which You are a party.
Your use of the Platform is at all times subject to applicable laws.

If You do not agree with any part of this Agreement, You must not use the Platform.

Access to the Platform is conditional upon Your acceptance and continuous compliance with these Terms.

3. User Accounts

To access the Platform and use the Services or purchase Content, You must create an account (“Account”).

By registering an Account, You:

Represent that all information provided (name, email, phone number, etc.) is accurate, current, and complete.
Agree to update your information as needed to keep it accurate and current.
Acknowledge that account registration on CelebKart is free of charge for both Creators and Subscribers. CelebKart does not charge Users for merely accessing the Platform.

You are solely responsible for all activities that occur under Your Account. CelebKart reserves the right, at its sole discretion, to disable or terminate any username, password, or Account if You violate these Terms or applicable laws, or if we reasonably suspect misuse or unauthorized activity.

Users are advised to review and comply with the Content and Platform Conduct Guidelines.

3.1 Information Collected for Registration and Account Creation

For Creators, Creators may be required to provide Personal Data such as:

Name
Email address
Mobile number
A unique username and password
Profile bio/description
Optionally: profile photo, links to social media profiles, YouTube channels, websites, blogs, etc.

This information helps strengthen the Creator’s brand presence.

For Subscribers, Subscribers may be required to provide:

Name
Phone number
Email address
Instagram username or similar identifiers (where applicable)

Users should review the CelebKart Privacy Policy to understand how their data and Personal Information are collected, processed, and stored.

By registering, You warrant that:

All information submitted is correct and complete;
You meet the eligibility criteria;
You will promptly update your information if any changes occur.

3.2 Age Restriction

You must be at least 18 years of age to sign up, access, and use the Platform independently.
Individuals below 13 years of age are not permitted to use or register for the Platform.
If You are between 13 and 18 years, You may only use the Platform with the consent and supervision of a parent or legal guardian. The parent or guardian, by allowing such use, agrees to be bound by these Terms and accepts responsibility for the minor’s actions on the Platform.

3.3 Compatible Devices

To access and use the Platform, You must use a Supported or Compatible Device, such as:

Desktop or laptop computer
Smartphone or tablet
Other electronic devices meeting the Platform’s minimum technical requirements

You are solely responsible for:

Maintaining compatible hardware and software
Installing required updates to keep accessing the Platform

CelebKart may modify supported device or software requirements from time to time.

3.4 Passwords and Security

You:

Must keep Your login credentials confidential.
Must not share Your username or password with any other individual or entity.
Are solely responsible for all actions taken through Your Account.

You should take reasonable precautions to avoid unauthorized access, particularly when using:

Public or shared devices
Unsecured networks

If You suspect that Your password has been compromised:

Change Your password immediately; and
If You are unable to do so, promptly contact CelebKart at [email protected] for assistance.

CelebKart may, at its discretion, take steps to protect Your Account, including temporary suspension, forced password reset, or other security measures.

4. Payments

4.1 For Subscribers

To provide a smoother payment experience, CelebKart uses third-party payment processors to handle all monetary transactions related to Content, Services, and Subscriptions.

For Subscribers in India, CelebKart currently uses third party payment gateways.
Users may be redirected to these external payment gateways to complete transactions.

We:

Do not control the data handling or security practices of these third-party providers.
Encourage You to review the Terms of Service and Privacy Policies of the third-party providers.

You agree that:

You are solely responsible for all charges incurred through the payment gateways.
CelebKart is not liable for errors, delays, losses, or issues arising from the acts or omissions of these third-party processors.

4.2 For Creators

For processing settlements to Creators, CelebKart uses equivalent third-party payment partners as updated from time to time.

These payment partners:

Are independent third-party processors;
May charge processing fees and require Personal Data to execute settlements.

Creators should review the respective Terms and Policies of the service provider to understand data and payment handling practices.

CelebKart is not responsible for:

Errors or delays in settlement processing by third-party payment service providers;
Any disputes or losses arising from their services.

5. Creators on CelebKart

5.1 Content

Creators are required to categorize their Content appropriately based on:

Context
Theme
Tone and potential impact
Target audience

Creators must strictly comply with applicable laws and Platform policies, including (where applicable) the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and must not upload Content that:

Promotes, depicts, or glorifies nudity, sexual abuse, pornography, paedophilia, necrophilia, child sexual abuse material, human or sex trafficking;
Promotes cult ideologies, drug or alcohol abuse, racial or communal hatred, violence, or self-harm behaviour;
Otherwise violates Platform Guidelines or any law in force.

Subscribers are encouraged to:

Refrain from engaging in any prohibited behavior as above;
Promptly report any violative Content or behavior via the designated grievance mechanism.

CelebKart reserves the right to remove Content and/or suspend or terminate Accounts for violations.

5.2 Creator Accounts

Once registered, Creators may be assigned:

A unique subdomain or page, and
Tools to manage their website, offerings, Content, pricing, and interactions.

5.3 License to Creators

As a Creator:

You retain ownership of Your Content.
You grant CelebKart a limited license to use and process Your Content for the purposes of operating the Platform.

CelebKart grants You a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Platform for Your personal and commercial purposes, subject to this Agreement.

You must not:

Reproduce, duplicate, copy, sell, or exploit any part of the Platform or CelebKart Content except as expressly permitted in writing.

5.4 Processing of Personal Information by Creators

CelebKart’s Data Processing Agreement (DPA) forms an integral part of this Agreement.

Creators may act as independent data controllers or processors vis-à-vis their Subscribers.
Creators must safeguard all Personal Data obtained via the Platform.
Creators must provide clear privacy notices and handle Subscribers’ Personal Data in compliance with applicable data protection laws.
Creators must cooperate with CelebKart in fulfilling data subject rights (e.g., access, deletion) where required.

5.5 Creator Fee

Creators have full discretion to set the pricing for their Content (“Creator Fee”).

CelebKart is not responsible for determining or controlling Creator pricing decisions.
Subscribers must pay the Creator Fee to access the Creator’s paid Content or Services.

5.6 Platform Service Charge

CelebKart charges Creators a Platform Service Charge, which is a percentage of the Creator Fee, in consideration for providing the Platform and its features.

For Non-GST Registered Creators: Platform Service Charge may be inclusive of GST.
For GST Registered Creators: Platform Service Charge may be exclusive of GST, and applicable taxes may be added.

Details may be outlined in Creator-specific commercial terms or dashboards.

5.7 Payments to Creators & Taxes

Creators are solely responsible for complying with all applicable tax laws, including GST, income tax, and any required filings.
CelebKart may deduct certain statutory levies (such as equalisation levy for non-Indian Creators, if applicable) before remitting settlements.

For Creators failing to furnish required tax registration details (e.g., GST registration upon crossing thresholds), CelebKart may:

Charge applicable GST on Creator Fee;
Issue invoices to Subscribers on the Creator’s behalf;
Remit GST to authorities, as required.

6. Subscribers on CelebKart

6.1 Subscriber Account

Once registered, Subscribers can:

Access their dashboard
View purchased Content, active Subscriptions, and preferences
Manage their payment methods and other settings (where applicable)

6.2 License to Subscribers

CelebKart grants Subscribers a limited, non-exclusive, non-transferable license to access and use the Platform and purchased Content for personal, non-commercial use, subject to this Agreement.

Subscribers may not:

Reproduce, copy, resell, sublicense, or distribute Content without the Creator’s and/or CelebKart’s explicit permission.

6.3 Digital Content and Virtual Products

Subscribers are not obligated to purchase any product or Service offered by Creators.
Access to or enrollment in any Content is governed by the individual Creator’s terms and may vary from Creator to Creator.
CelebKart operates as a facilitator/intermediary between Creators and Subscribers and is not a party to the underlying contract for Content.

Subscribers are solely responsible for ensuring that viewing, downloading, or accessing Content complies with:

Local laws and regulations;
Any applicable content control laws or export restrictions.

6.4 Subscriber Payments

Subscribers pay the Creator Fee to access paid Content or Services.

Payments are processed through integrated payment partners.
Subscribers are responsible for ensuring their payment details are accurate and valid.

CelebKart:

Acts only as an intermediary for payment facilitation;
Is not responsible for refund obligations between Creator and Subscriber unless explicitly stated in Platform refund policies.

6.5 Cancellation of Products and Subscriptions

To cancel a Subscription or access to a purchased digital product or Content, Subscribers may write to [email protected].

For Subscriptions: Access may continue until the end of the billing period or expiration date, as applicable.
For instant-delivery digital products: You consent to immediate delivery upon purchase, which may limit refund options subject to platform or Creator-specific policies.

7. Access to the Platform

7.1 Internet and Browser Requirements

You may need a stable internet connection and supported browser versions to fully access the Platform.

Data or connectivity charges from Your network or service provider are Your responsibility.

7.2 App Permissions

By downloading or using the CelebKart App, You may be asked to grant permissions (e.g., storage, camera, microphone, notifications).

You may manage these permissions via Your device settings.
By using the App, You agree to receive automatic software updates, where available.

8. Communication on the Platform

CelebKart reserves the right to remove any Content or links that violate applicable laws; breach these Terms or Platform Guidelines; or are deemed offensive, harmful, or inappropriate.
Communication features (such as chats, comments, or subscription communities) are not actively monitored at all times. However, CelebKart may take action upon receiving complaints or noticing misconduct.

You acknowledge that:

User Content (including chats, posts, or comments) is not endorsed by CelebKart.
You are solely responsible for any Content You publish or share.

Zero tolerance for objectionable content and abusive behaviour

CelebKart has zero tolerance for objectionable content and abusive users. By using the Platform You agree that You will not post, share, or transmit content that is unlawful, hateful, harassing, threatening, defamatory, obscene in violation of these Terms, or otherwise objectionable, and that You will not engage in abusive behaviour toward any other user.

Every user can report (flag) objectionable content or abusive users from within the apps and the website, and can block users they do not wish to interact with. Blocking immediately stops further interaction from the blocked user and is escalated to our moderation team.
Our moderation team acts on objectionable-content reports within 24 hours — removing the offending content and, where warranted, suspending or permanently ejecting the user who provided it.
Content published on the Platform passes through moderation controls, and CelebKart may remove any content or terminate any account at its sole discretion.

9. Disclaimer of Warranties

The Platform, Content, and Services are provided on an “AS IS” and “AS AVAILABLE” basis.

To the fullest extent permitted by law:

CelebKart and its officers, directors, employees, and agents disclaim all warranties, express or implied, including but not limited to warranties of accuracy, reliability, merchantability, fitness for a particular purpose, and non-infringement.

CelebKart does not warrant that:

The Platform will be uninterrupted, secure, or error-free;
Any defects will be corrected;
The Platform or servers are free of viruses or harmful components;
Any Content or information obtained is accurate or reliable.

You use the Platform at Your sole risk.

10. Limitation of Liability

To the fullest extent permitted by law:

CelebKart, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or related to Your use or inability to use the Platform or Services.

This includes, without limitation:

Any errors, inaccuracies, or omissions in Content;
Unauthorized access to or alteration of Your data;
Any interruptions, bugs, viruses, or failures of the Platform;
Any conduct of other Users or third parties.

Your exclusive remedy, if any, against CelebKart for any claims or damages is limited, at most, to the amount You paid (if any) for access to the Platform or Services in the preceding three (3) months.

11. Content Liability

You are solely responsible for Content you upload or share.

By uploading Content, You represent and warrant that:

You own or have the necessary rights and permissions to use and license such Content;
Your Content is lawful, non-infringing, and does not violate the rights of others;
Your Content complies with Platform policies and applicable laws.

You grant CelebKart a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to:

Host, store, reproduce, transmit, display, and distribute Your Content as necessary to provide Services;
Analyze and process Content for moderation, algorithmic optimization, and service improvement;
De-identify and aggregate data for analytics and product enhancement.

CelebKart may remove or restrict access to Content that it reasonably believes violates:

This Agreement;
Platform Guidelines; or
Applicable laws or third-party rights.

12. Indemnification

You agree to defend, indemnify, and hold harmless CelebKart, its parent, affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your use of or access to the Platform;
Your violation of these Terms;
Your infringement of any third-party rights;
Any Content You upload or share;
Any misrepresentation made by You.

This indemnification obligation survives termination of this Agreement.

13. Intellectual Property and Rights

13.1 CelebKart’s Content

All content and materials provided by CelebKart, including but not limited to:

Platform design, layout, look and feel;
Logos, trademarks, service marks;
Graphics, text, audio, and video elements;
Source code and software

are the exclusive property of CelebKart or its licensors (“CelebKart Content”).

You may not:

Reproduce, distribute, modify, or create derivative works from CelebKart Content without our prior written consent.

13.2 Feedback

If You submit suggestions, comments, or feedback (“Feedback”) about the Platform:

You grant CelebKart a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and incorporate such Feedback into the Platform without any obligation to You.

You gain no ownership rights in the Platform by virtue of providing Feedback.

13.3 User Content Ownership

You remain the owner of Your Content. CelebKart does not claim ownership over the Content You upload.

However, You grant CelebKart the licenses described in Section 11 to operate the Platform and provide Services.

13.4 Copyright Complaints & Takedown Policy

CelebKart responds to properly submitted copyright infringement notices in compliance with applicable intellectual property laws.

If You believe that Your copyrighted work has been infringed on the Platform, You may submit a written notice to the designated IP/Grievance Officer with all required details.

CelebKart may:

Remove or disable access to allegedly infringing Content;
Notify the Content uploader;
Process counter-notices where applicable.

Repeated infringement may result in account suspension or termination.

13.5 Trademarks

“CelebKart,” the CelebKart logo, and all related names, logos, product and service names, designs, and slogans are trademarks of CelebKart or its affiliates.

You must not use such marks without prior written permission.

14. Changes to Terms of Service

CelebKart may update or modify these Terms at any time.

We will notify Users by email and/or via the Platform at least seven (7) days prior to changes becoming effective, where required.
Continued use of the Platform after such changes constitutes Your acceptance of the updated Terms.

15. CelebKart’s Rights

CelebKart reserves the right to:

Remove or suspend any User Account or Content violating this Agreement or applicable law;
Modify, suspend, or discontinue any part of the Platform or Services at any time;
Retain a copy of Your Content after termination for limited legal, security, or audit purposes (subject to license terms).

16. User Rights

Subject to applicable law, Users may have:

Data protection and privacy rights (e.g., access, correction, deletion) as per relevant data protection laws;
The right to withdraw from this Agreement by discontinuing use of the Platform.

17. Termination or Suspension

CelebKart may terminate or suspend Your Account:

For any violation of these Terms;
For suspected fraudulent or illegal activities; or
As required by law or authority.

CelebKart will, where reasonable, notify You of the reason unless such disclosure:

Violates law or law enforcement direction;
Compromises an investigation;
Risks Platform security or integrity; or
May cause harm to CelebKart or third parties.

Termination does not entitle You to compensation.

17.1 Account Deletion by User

You may request deletion of Your Account by emailing [email protected].

Upon deletion:

Your Content may become inaccessible or permanently deleted;
You remain responsible for any outstanding obligations or dues;
Creators must ensure all active Subscribers and pending obligations are duly handled before deletion.

17.2 Survival

Provisions intended by their nature to survive termination (e.g., licenses, indemnities, limitation of liability, IP provisions) shall continue in effect after termination.

18. Disputes, Governing Law & Jurisdiction

To the fullest extent permitted by law:

These Terms are governed by the internal laws of Bengaluru, Karnataka, without regard to conflict of law principles.
Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.

19. Miscellaneous

Creator–Subscriber Relationship: CelebKart is not a party to the contract between Creators and Subscribers and is not liable for disputes or claims arising between them.
Privacy: Please refer to the CelebKart Privacy Policy for details on data use.
Communications: By providing Your email/phone, You consent to receive communications (including transactional, support, and service notices) from CelebKart.
Assignment: You may not assign this Agreement without our prior written consent. CelebKart may assign this Agreement without restriction.
Waiver: Failure to enforce any provision shall not be considered a waiver of that provision.
Severability: If any provision is found unenforceable, the remaining provisions will continue in full force and effect.
Force Majeure: Neither party is liable for failures due to events beyond reasonable control (e.g., natural disasters, war, cyberattacks, government actions).
Losses: CelebKart is not responsible for business losses or indirect damages, except where liability cannot be excluded by law.
